The following Terms of Use define your obligations when using the Flushit website.

Acceptance of Terms
The web pages at flushit.net, and all linked pages ("Site"), are owned and operated by Randall Toews, the sole proprietor of Flushit, a company registered in British Columbia, Canada, and are accessed by you under the Terms of Use described below ("Terms of Use").
You hereby agree to be bound by these Terms of Use in their entirety. If you do not agree to be bound by ALL of the following Terms of Use, then you are expressly prohibited from accessing and using the Site, including any content or services provided by the site, in any way, shape, or form.
Modification of Terms of Use
Flushit reserves the right, at its sole discretion, to alter the Terms of Use at any time. Any material alteration of the Terms of Use will be announced and posted on the Site. It is your responsibility to familiarize yourself with any alterations to the Terms of Use and to accept and abide by the modified Terms of Use in order to retain the right to access the Site.
Description of Service
Flushit may offer certain content ("Content") and services ("Services"), as described on the Site. Services include, but are not limited to, any service Flushit performs or Content Flushit provides, where Content includes, but is not limited to, text, user comments, messages, information, data, graphics, news articles, photographs, images, illustrations, software, audio clips and video clips. Flushit may alter, limit, restrict, or discontinue any part of its Services, including any Content, at any time and for any reason, without notice or liability.
Registration
You are required to register with Flushit and choose a username (User ID) and password. You agree to provide accurate and up to date registration information. Failure to do so constitutes a breach of the Terms of Use. You may not use as a User ID the name of another person with the intent of impersonating them. Nor may you use as a User ID a name that is offensive, vulgar, or obscene. Flushit may, at its discretion, refuse to register a User ID or delete any existing User ID at any time.
You must be at least 13 years old to register a User ID with Flushit.
User Conduct
You hereby agree not to use the Site and its Services in any way that is illegal or prohibited by these Terms of Use, nor for any other purpose not reasonably intended by Flushit. In particular, you agree not to use the Site and its Services:
1. to abuse, harass, threaten, impersonate or intimidate other Flushit users;
2. to post, transmit, or cause to be posted or transmitted, any Content that is obscene, pornographic, libelous, defamatory, or violates any law or any right of any third party;
3. to post, transmit, or cause to be posted or transmitted, any communication or solicitation designed to obtain the password or private information of any Flushit user;
4. to violate any laws in your legal jurisdiction;
5. to send unwanted email, or spam, to any other Flushit users or any URL;
6. to make submissions or comments that link to affiliate programs, multi-level marketing schemes, or off-topic content;
7. through the use of a robot, spider, scraper, or other automated means to access the Site, without the express written consent of Flushit. In addition, you agree not to take any action that will impose an unreasonably large load on our infrastructure, interfere or attempt to interfere with the proper operation of the Site and its Services, or bypass measures taken to limit or restrict access to the Site;
8. with the intention of artificially altering any of the Content or Services of the Site, including the number of flushes a particular submission has received;
9. to advertise to or solicit any user to buy or sell any products or services;
10. to sell or transfer your profile;
11. to attempt to impersonate another user.
Flushit may delete any Content and any user account at any time and for any reason.
Content Submitted to the Site
By providing Content for display or inclusion on the Site, you warrant that you own all rights to the Content and agree the Content will be in the public domain as per the Creative Commons Public Domain Dedication, found at http://creativecommons.org/licenses/publicdomain/. Note that this does not apply to the content found on the external sites to which Flushit links.
Copyright
Flushit will investigate notices of alleged copyright infringement and act in accordance with the Digital Millennium Copyright act ("DMCA") and other relevant intellectual property laws. Flushit will terminate the accounts of repeat infringers.
To notify Flushit of copyright infringement, send a written statement to X that sets forth the information contained in the DMCA.

Indemnity
You indemnify and hold harmless Flushit, its customers, vendors, officers and employees from any liability, damage or cost from any claim made by any third party arising out of your access to the Site and use of its Services.
Warranty Disclaimer
The Site, Services and Content are provided on an "as is" basis, without any warranties, either express or implied. Flushit makes no representation concerning any content contained on the Site or accessed through its Services, and Flushit will not be liable for the accuracy, copyright compliance, legality, or decency of any material contained on or accessed through the Site and its Services.
Links
The Site, its Services, or third parties may provide links to other websites or online resources. You hereby acknowledge that Flushit is not responsible for the availability of such external sites and resources, and is not responsible or liable for anything provided by such sites or resources.
Limitation of Liability
In no way shall Flushit or its suppliers by liable under any legal principle with respect to the Site, the Services, or any Content, for any loss or non-direct damages of any kind whatsoever, or any direct damages in excess of $100 in total.
Termination of Account
Flushit may delete or suspend your account and deny access to the Site or use of its Services at any time, without prior notice or liability, if you breach any portion of the Terms of Use. You may terminate your Flushit account by ceasing to use the Site and Services.
Miscellaneous
No agency, partnership, joint venture, or employment is created as a result of the Terms of Use and you do not have any authority of any kind to bind Flushit in any respect whatsoever.
Trademarks
Flushit, Flushit.net, Flushit!, Flush it, and other Flushit graphics, logos, designs, page headers, button icons, scripts, and service names are trademarks, registered trademarks or trade dress of Flushit in the US and/or other countries. Flushit's trademarks and trade dress may not be used in connection with any product or service, including as part of a website domain name, in any manner likely to cause confusion.
